It is illegal(at least in the uk) for an employee to be discriminated against if the have the HIV virus.The law has also been changed to the extent that it says that having the virus is not a determinate death sentence anymore so therefore you are able to work and live(erm.....) as normal for as long as you don't have fully developed aids.
