its sucks but basically you are "playing with fire" when dealing with videos like that, but wasn't YouTube being sued by ViaCom because of video content that infringed copyright issues. you can't ultimately blame YouTube... and doesn't ViaCom own VH1 which is linked to MTV... i haven't kept in touch with all of these current issues to completely understand whats going on, though i;d think that YouTube ultimately had to do something it seems on this issue because ViaCom pushed them into a corner...
Really though its shitty, because alot of this sort of material is done as an archival/promotional type of thing and people want to see it for that reason, individual users can't make money based on these videos can they? that is where i think the copyright infringement issue should lie, within those who try to make money on it illegally. but i guess the thinking is that if someone is able to view it for free on youtube they would never consider renting it or buying thus the companies who put these videos out are losing money.
